JobFLEX Privacy Policy

JobFLEX site and its related products and services including web-site, software and apps (“the Site”) are included under this privacy policy. JobFLEX has adopted this Privacy Policy (“Privacy Policy”) to inform its users and customers (“you”) that it collects personal information (“Personal Information”) when you use the Site and to explain how this Personal Information is used. By accessing or using the Site or the Content provided on or through the Site, you agree to follow and be bound by this Privacy Policy as well as the Terms of Use, which is hereby incorporated by reference. JobFLEX may modify, amend, suspend, terminate, or replace this Privacy Policy from time to time within its sole discretion. The Effective Date, located above, will change upon any such modification, amendment, or replacement of this Privacy Policy. Your continued use of the Site after a change in the Effective Date of this Privacy Policy constitutes your manifestation of assent to the modification, amendment, or replacement contained herein.


“Customer Information” is information that we may collect from your use of the Site and your interactions with us off-line. We deal with Customer Information according to the terms of this Privacy Policy.

“Services Data” is data that resides on JobFLEX, customer or third-party systems to which JobFLEX is provided access to perform services (including on-demand environments as well as test, development and production environments that may be accessed to perform JobFLEX consulting and support services). JobFLEX treats Services Data according to the terms of this Privacy Policy, and treats Services Data as confidential in accordance with the terms of your order for services.

To illustrate the difference between Customer Information and Services Data, when a customer contracts with JobFLEX for on-demand services, the customer provides information about itself, including its name, address, billing information, and some employee contact information. The Site may also collect some information about the customer and some employees as part of that interaction. All of that information is Customer Information and is treated according to this Privacy Policy. In contrast, having contracted with JobFLEX for on-demand or other services by downloading any apps or accessing JobFLEX software, the customer then provides JobFLEX with access to its production, development or test environment, which may include Personal Information about its employees, customers, partners or suppliers (collectively “End Users”).

Below are the conditions under which JobFLEX may access, collect and/or use Personal Information and Services Data. To provide services, Services Data may be accessed and used to fulfill the requirements specified in your order for support, consulting, on-demand or other services. JobFLEX may collect the following Personal Information, without limitation:

  • Any information that you submit to the “Site”
  • Contact information, such as first and last name, physical address, telephone number(s), email address, company name, company website, and company email address. The majority of the information collected under this category is business contact information and when this information is collected in forms on the Site, it is collected and/or transmitted using Secure Socket Layer (SSL) technology
  • Your use of the Site, including transactional information, information about the products and services you purchase or download, or about which you inquire
  • User preferences, such as product requirements, areas of industry interest, newsletters, community choices and other information you select in the customer profile when registering on the Site or indicated by your use of the Site and any of the JobFLEX products or apps
  • Financial, credit card, and payment information
  • Event and conference participation information such as lectures, classes or booths attended or visited during an event or conference hosted or attended by JobFLEX or JobFLEX. If we use electronic tracking technologies at an event, we will provide notice in the event registration materials and/or correspondence
  • Information received from third parties
  • Your geolocation
  • Electronic Communications Protocols and Cookies: In addition to the information specified above, JobFLEX may collect information about your use of the Site through electronic communications protocols and cookies. JobFLEX may automatically receive information from you as part of the communication connection itself, which often consists of network routing information (where you came from), equipment information (browser type), your IP address, and date and time. JobFLEX also uses cookies, embedded URLs and embedded pixels to capture additional information.
  • Cookies: A cookie is a small piece of information sent by a Web server to store on a Web browser so it can later be read back from that browser. Cookies on the Site may collect a unique identifier, user preferences and profile information and membership information. JobFLEX also uses cookies to collect general usage and volume statistical information that does not include personally identifiable information. Your browser may provide you with information and control over cookies. You can set your browser to alert you when a cookie is being used, and accept or reject the cookie. You can also set your browser to refuse all cookies or accept only cookies returned to the originating servers. Users can generally disable the cookie feature on their browser without affecting their ability to use the site, except in some cases where cookies are used as an essential security feature necessary for transaction completion. Cookies, however, are important to the proper functioning of the Site and disabling them may degrade your experience and interfere with Site features and customizations.
  • Embedded URLs: JobFLEX also uses a tracking technique that employs embedded URLs to allow use of the site without cookies. Embedded URLs allow limited information to follow you as you navigate the site, but is not associated with Personal Information and is not used beyond the session.
  • Embedded Pixels: On the Site, JobFLEX may use embedded pixel technologies on selected pages for the purposes of identifying unique user visits to the Site as opposed to aggregate hits. In addition, embedded pixels or other technologies may be used in emails to provide information on when the email was opened to track marketing campaign responsiveness; information collected using these technologies may be associated with the recipient’s email address.
  • Third Party Cookies: JobFLEX has engaged one or more third party service providers to track and analyze usage and volume statistical information from visitors to the Site. The service provider(s) set cookies on behalf of JobFLEX. JobFLEX also uses other third party cookies to track the performance of JobFLEX advertisements on their websites.
  • JobFLEX may re-associate the information provided by the technologies directly above with Personal Information.
  • Widgets: Our Site includes Widgets, which are interactive mini-programs that run on our site to provide specific services from another company (e.g., links to bookmarked sites). Personal information, such as your email address, may be collected through the Widget. Cookies may also be set by the Widget to enable it to function properly. Information collected or used by a Widget, including cookie settings and preferences, is governed by the privacy policy of the company that created it.
  • Analytic Data from Google Analytics or other third party analytics tools.
  • Any other additional data that you voluntarily submit to the Site, App or any of the JobFLEX software products.
  • Log File, Device ID’s and Clear Gifs: We collect information related to your browser or mobile device each time you access the site or use the application or service. This information may include but not be limited to address, browser type, mobile device information, page visits, emails opened or not opened and other information used to improve our product and service offerings.

JobFLEX may use the Personal Information in the following ways:

  • To engage in transactions. JobFLEX may use Personal Information such as name, physical address, telephone number, email address, and company to engage in transactions with you, including contacting you about your order or download.
  • To process transactions. JobFLEX may use financial/credit card and payment information to process your order. JobFLEX may need to share some of this information with delivery services, credit card clearing houses and other third parties to complete the transaction.
  • To provide support or other services. JobFLEX may use your Personal Information to provide you support or other services you have ordered, as well as product updates, product patches and fixes and other similar communications.
  • To tailor marketing to your needs and respond to your requests. JobFLEX may use your Personal Information to notify you about new product releases and service developments. JobFLEX also may use your Personal Information to respond directly to your requests for information, including registrations for newsletters or other specific requests, or pass your contact information to the appropriate JobFLEX distributor or reseller for further follow-up related to your interests. In addition, JobFLEX may share your contact information with other selected partners or third parties that offer complementary products or services. These providers or third parties may include complimentary service offerings such as lead processing, payment processing or payment information. Please review the specific partner’s privacy policy regarding any further interactions with them however; these vendors’ privacy policies will protect your information in a manner consistent with this privacy policy.   • To provide online forums and social networks. Some services available on the Site permit you to participate in interactive discussions, post comments, opportunities or other content to a bulletin board or exchange, or otherwise engage in networking activities. Some of these services are moderated; all may be accessed for technical reasons. JobFLEX does not control the content that users post to these forums or social networks. You should carefully consider whether you wish to submit Personal Information to these forums or social networks and should tailor any content you submit appropriately and in accordance with the relevant terms of use. In addition, you should review any additional terms and conditions that may govern your use of these services, including terms related to use, sharing your Personal Information and receiving communications; any such terms will be clearly identified on the relevant site.
  • To administer product downloads. JobFLEX may contact you if you download products to confirm certain information about your order (for example, that you did not experience problems in the download process), discuss the downloaded products or provide marketing or sales information about related products and services. JobFLEX also may use this information to confirm compliance with terms of use and other policies and may share it with your company.
  • To select content, improve quality and facilitate use of the Site. JobFLEX may use your Personal Information, including the information gathered as a result of site navigation and electronic protocols and cookies (including third party cookies), to help create and personalize Site content, facilitate your use of the Site (for example, to facilitate navigation and the login process, avoid duplicate data entry, enhance security, keep track of shopping cart additions and preserve order information between sessions), improve Site quality, track marketing campaign responsiveness, and evaluate page response rates.
  • To maintain and upgrade a system. Technical staff may require periodic access to Services Data to monitor system performance, test systems and develop and implement upgrades to systems. Any temporary copies of Services Data created as a necessary part of this process are only maintained for time periods relevant to those purposes.
  • To address performance and fix issues. On occasion, JobFLEX may develop new versions, patches, updates, and other fixes to its programs and services (such as security patches addressing newly discovered vulnerabilities). In accordance with the terms of your order for services and/or with notice to you, we may access and/or use a copy of your test, development or production environment, including Services Data, to test such new versions, patches, updates and fixes and validate that they work in your environment(s).
  • As a result of legal requirements. JobFLEX may be required to provide personally identifiable information to comply with legally mandated reporting, disclosure or other legal process requirements. JobFLEX may transfer and access Services Data globally as required for the purposes specified above. If JobFLEX hires subcontractors to assist in providing services, their access to Services Data will be consistent with the terms of your order for services and this services privacy policy. JobFLEX does not use Services Data except as stated above or in your order. JobFLEX may process Services Data, but does not control your information collection or use practices for Services Data. If you provide any Services Data to JobFLEX, you are responsible for providing any notices and/or obtaining any consents necessary for JobFLEX to access and use Services Data as specified in this policy and your order.

JobFLEX’s access to Services Data is based on job role and responsibility. Services Data residing in JobFLEX hosted systems is controlled via an Access Control List (“ACL”) mechanism, as well as the use of an account management framework. You control access to Services Data submitted by End Users/Employees; End Users should direct any requests related to their Personal Information to you as you are responsible for processes related to access control, administrative rights and security related to the use of your computer and software systems.


This Site is not marketed to or intended for use by individuals who cannot legally bind a contract. JobFLEX does not intentionally gather any Personal Information about visitors or customers who are under the age of 18. If you are under the age of 18 or otherwise lack the capacity to enter into an agreement, do not use our Site, services or products. Please ask an adult to establish an account with us instead.

If you are concerned that Personal Information may have been inadvertently provided to or collected by JobFLEX, please contact us immediately so appropriate steps may be taken to remove such information from our database.


California residents have the right to receive information that identifies any third party companies or individuals that JobFLEX has shared your Personal Information with in the previous calendar year, as well as a description of the categories of Personal Information disclosed to that third party. JobFLEX is committed to the security of Services Data, and has in place physical, administrative, and technical measures designed to prevent unauthorized access to that information. JobFLEX security policies cover the management of security for both its internal operations as well as the services. These policies govern all areas of security applicable to services and apply to all JobFLEX employees.

JobFLEX or its third party providers have security measures in place to protect against the loss, misuse, and alteration of your Personal Information in our customer database. Personal Information provided to JobFLEX is stored in secure facilities with access restricted to authorized personnel only. Although we make good faith efforts to store the Personal Information we collect in a secure operating environment that is not accessible to unauthorized users, we cannot guarantee complete security and transmitting personal information is done at your own risk.

All Credit Card processing (Including Orders, Fees or Re-occurring Billing) on our website are processed through a payment gateway which operates under its own privacy policy. If you choose to purchase JobFLEX Products or Services online using a credit card, the credit card information is sent directly to this payment gateway using a SSL (Secure Socket Layer) encryption and static IP address. This is an industry-standard method for protecting data as it travels over the Internet, or a similar encryption technology that may become accepted as an industry standard or better encryption method, in the future (“Transmission Encryption”). Our third party payment processors and credit card processing vendors comply with Payment Card Industry Data Security Standard (PCI-DSS) and other industry standards referenced in their privacy policies. For security reasons, customers shall not and cannot access files from the data center unless they use JobFLEX software and protocols.

JobFLEX’s Support, Consulting and on-demand lines of business have developed detailed statements of security practices that apply to many of their service offerings, which are available for review at your request at

JobFLEX’s security policies and procedures are reviewed by the JobFLEX Board of Directors and Management Team. The management team is responsible for security oversight, compliance and enforcement, and for conducting information security assessments and leading the development of information security policy and strategy.

JobFLEX is also committed to reducing risks of human error, theft, fraud, and misuse of JobFLEX facilities. JobFLEX’s efforts include making personnel aware of security policies and training employees to implement security policies. JobFLEX employees are required to maintain the confidentiality of Services Data. Employees’ obligations include written confidentiality agreements and compliance with company policies concerning protection of confidential information. JobFLEX promptly evaluates and responds to incidents that create suspicions of unauthorized handling of Services Data. JobFLEX IT and Legal staff and advisors are informed of such incidents and, depending on the nature of the activity, defines escalation paths and response teams to address the incidents. If JobFLEX determines that your Services Data has been misappropriated (including by a JobFLEX employee), JobFLEX will promptly report such misappropriation to you.


JobFLEX may purchase other businesses or sell components of its business, including, but not limited to, the Website, App, Software or any related products or services. In the event JobFLEX purchases another business or sells any component of its business, Personal Information will continue to be used consistent with the terms of this Privacy Policy.
